    Topic:  As The (Employment Law) World Turns: Where Have We Been And Where Are We Going?

    This presentation will discuss some key developments and hot topics emanating from the Biden Administration in wage and hour law, including those taking place at or through the U.S. Department of Labor, and touch on some labor-related issues evolving from the National Labor Relations Board.  We’ll take a peek at the past under the Trump Administration, while providing comparisons to the actions in the first 50 days of the new administration.  We’ll also address some insight and thoughts about the pandemic impact and what the future holds in the employment regulatory realm.  We’ll do our best to provide guidance and “predictions” to help you navigate the world of employment law in 2021 and beyond.  Below is a brief list of some of the questions we’ll entertain: 

    1.      Will Wage And Hour Issues And The Department Of Labor Return To Center Stage?

    a.    Some new DOL leadership has arrived, but how much will it change the direction of the DOL?  Will the world of wage and hour return to the Obama era for employers, possibly unleashing the dogs of enforcement?  Will any progress for employers be undone in the next four years?

    b.   The last 15+ years have been banner years for wage and hour claims.  They have grown exponentially, but will that continue? 

    2.     The PRO Act, Pro-Labor Sentiments in D.C., And The NLRB – Could An Employer’s Obligations Be Enhanced, Regardless Of Whether It Employees Unionized Workers?    

    a.    What are the prospects in Congress and for President Biden to deliver on “promises” to labor unions?  How long will it take the NLRB to change course and revert back to an approach more in line with the eight years under the Obama Administration? How do things work at the NLRB anyway? 

    b.    With unions across the country seemingly less powerful and less successful, the NLRB is expected to ultimately shift its energy more toward assisting union organizing and even focus somewhat more on the non-union workplaces – could we return to the “gotcha game” of hammering employers across the country for purported unlawful policy implementation and subsequent employee discipline and discharges based upon those policies?  

    3.     Will Our Employment World Become More Or Less Complicated? 

    a.   Following nearly eight years under the Obama Administration, where employers across the country faced numerous impediments to, and complications for, successful employee relations, employers saw a more relaxed regulatory environment for four years of the Trump Administration.  Now, what? 

    b.   What does the near future hold for the proliferation of claims against employers?
