THE FIRST 48 – PROTECTING YOUR ASSETS FROM UNFAIR COMPETITION
HR’s Role and What to Do!
Not only are you responsible to ensure you obtain the appropriate documents / agreements at time of hire but also ensuring that the specific restrictions and protections are implemented should an employee leave either voluntarily or involuntarily.
This session will cover what an employer should do within the first 48 hours of learning that an employee has gone to work for a competitor in violation of a non-competition agreement, or under circumstances in which trade secrets are at risk.
Topics will range from blocking the former employee’s access to company data, securing physical and digital evidence of non-compete activity or trade secret theft, evaluating the enforceability of the restrictive covenants, investigating whether employees have been solicited to follow the departing employee, and preparation of “notice of non-compete” and “cease and desist” letters and litigation hold notices.
