Topic description: The DOL will propose new regulations relative to exempt employees. While we don't know what the regulations will be, it is clear that it will be harder to meet the exemptions.
Before we focus on new rules for exempt employees, we should make sure that we are compliant with regard to our non-exempts. This program will cover some of the more commonly litigated FLSA claims involving non-exempt employees that have resulted in eight-digit settlements and judgments.
Issues to be addressed include: whether and when commissions, bonuses and other compensations must be included in calculating the regular rate for overtime purposes; compensation for preliminary and postliminary activities; compensation for work from home; compensation for training time, travel time and break time; automatic deductions for meal breaks; rounding up and down for lateness and overtime; and how working off the clock happens (and can be avoided).
