Don't Fear the ADA (or don't start out asking for a Fitness for Duty)

Invite your supervisors / managers to learn about their role in ADA issues.

Many organizations fail to recognize when an employee seeks or is eligible for a reasonable accommodation.

This presentation will seek to showcase not only the requirements related to engaging in the interactive process, but also note that 80% of accommodations that are sought actually have a tangible cost to the company.

The presentation will also note that companies who engage employees in the interactive process, have higher rates of retention as well as reduced risk for failing to comply with the ADA by engaging in the interactive process.

    Learning Objective 1

Attendees will be able to share their understanding of the ADA and the interactive process.

Attendees will be able to describe the history of the ADA, the updates related to the ADAAA as well as the requirements related to the interactive process.

    Learning Objective 2

Attendees will be able to describe & explain the interactive process, the requirements related to documentation requests from a medical professional as well as noting situations in which an organization may not need to engage in the interactive process i.e, when the accommodation is readily apparent.

    Learning Objective 3

A common misconception is accommodations must be permanent.

Attendees will have a confidence in having discussions related to the interactive process and the knowledge that accommodations in many cases can be tried on a trial basis and also that the accommodations can be revisited.
