     Topic:  Conducting Workplace Investigations and Using Modern tools

     Description:

    This workshop will discuss various types of investigations in the workplace, i.e. harassment, discrimination, whistleblowing, conflict of interest, suspected fiduciary duty violations and employee fraud or theft.  We will share how to utilize modern tools such as social media, the internet and other technology in conducting such investigations.

    Learning objectives:
    1. Providing a step-by-step guide in conducting internal investigations.
    2. Educating HR professionals as to applicable laws to be considered in conducting internal investigations. 
    3. Advising on how to navigate technology, the internet and social media in connection with conducting internal investigations.
    Description:
    We will discuss the nuts and bolts of conducting internal workplace investigations in 2018, including modern issues such as technology and social media that must be considered in conducting such investigations.  Specifically, the session will cover all the steps of an investigation:
    • Determining if and when an investigation is necessary
    • Deciding what kind of investigation to conduct, formal or informal, whether to use outside investigator or counsel
    • Legal issues surrounding internal investigations and how to comply with all such laws
    • Collection of evidence, and modern tools for so doing
    • Preservation of all potential evidence, including electronic evidence
    • Conducting witness interviews
    • How to draw conclusions following an investigation
    • Memorializing and documenting the investigation
