Overview
Despite considerable opposition from employers, the United States Occupational Safety and Health Administration (OSHA) has issued its new regulatory rule expanding employers’ requirements for reporting and submitting workplace injuries and illnesses and making such records publicly available. The rule also provides several anti-retaliation components bestowing additional protections on employees involved with reporting work-related injuries and illnesses, and it provides the agency with enhanced investigation and enforcement measures to be utilized in reporting work-related incidents.
While the new rule faces proposed legal challenges, it is likely that some aspects of the rule will be upheld. As of this writing, OSHA has delayed enforcement of the rule until November 1, 2016.
In this presentation, Ms. Toth and Ms. Jackson will discuss key concerns for employers, including new electronic reporting requirements and electronic submission of OSHA forms; public posting of data in the OSHA Employee Injury and Illness Database; new anti-retaliation provisions; and post-incident drug testing and safety programs.
