    Over the past two years, legislators throughout the country, including New Jersey and New York, have passed laws that impact employers, such as:

    • Pregnant Worker's Fairness Act
    • Security and Financial Empowerment Act ("SAFE")
    • Paid sick leave laws
    • Online communications and "cyber-harassment" laws

    Meanwhile, the courts and government agencies have been similarly busy:

    • The United States Supreme Court declared the definition of marriage in the Defense of Marriage Act ("DOMA") unconstitutional, impacting the employer-employee relationship and employment-related benefits for individuals in lawful same-sex marriages who reside in states that recognize such marriages.
    • A New Jersey District Court found that an employer's handbook provision giving the employer the exclusive ability to change the handbook invalidated an employee's arbitration agreement.
    • The EEOC has issued new background check guidance and has heightened its enforcement of pregnancy bias.
    • The NLRB has maintained an aggressive position on employer policies, weighing in on everything from confidentiality in investigations to "courtesy" requirements.

    This Roundtable will provide you with an overview of the policies to review and revise in light of these developments, including pregnancy accommodation, paid leave, domestic violence leave, electronic communications, social media, background checks, employee agreements, and handbook disclaimers.

    Attendees will learn about the new laws, decisions and EEOC activity and the impact of the legislation and developments on employers, and our presenters will make recommendations for revisions to your policies to minimize your company's risk for employment claims.
