In today’s labor market it is difficult to attract and hire the candidates you need. Sometimes we try some innovative techniques, or so we think, that could get us into the legal quagmire. This session will share some shortcuts and processes that could result in legal issues.
The interviewing and hiring process has always been fraught with potential legal risks for businesses. Non-compliant job applications, inappropriate social media screenings, unlawful interview questions, failure-to-hire claims – all of these (and more!) pose significant legal issues. What are some other potential legal issues:
- FCRA violations
- Anti-Trust and Non-Compete Issues
- EEOC and NJLAD plus ADA Accommodations
- Artificial Intelligence concerns
With companies expanding their Diversity, Equity and Inclusivity (DEI) initiatives and trying to address the gig economy, there is a lot to think about while making the right hiring decisions.
During the time of the Great Resignation, when more and more employees are leaving their jobs, employers need to consider what they can do to prevent an exodus and to recruit the best talent for their organizations.
