    Summary

    As an HR Manager, you typically deal with employees who report to work. Times have changed due to the pandemic and the labor shortage.  What are some legal issues that may arise when you attempt alternative staffing arrangements.  What issues arise with remote work situations, such as wage and hour.  What happens when you are asked to deal with issues involving temporary staff? How do you spot an independent contractor arrangement? What are the issues when the lines between temporary staff, independent contractor and employee blur in the workplace?

    Are there concerns about confidentiality agreements or non-competes. 

    What other issues may be coming your way.  Will the NLRB revert back to micro units, define an employee or independent contractor and joint employer differently. 

    This session will provide an overview of the definition of independent contractor under New Jersey law and discuss the recent legislative activity regarding improper characterizations of independent contractors vs. employees. In addition, this session will provide an overview of temporary staffing agreements, joint employer status and review typical temporary staff structures. Finally, this session will review liability issues that occur with temporary staff and independent contractors.

    • Identify the difference between independent contractors and employees under New Jersey law.
    • General understanding of division of responsibility with temporary staff arrangements.
    • Issue spot potential liability problems with temporary staff and independent contractor arrangements.
    • NLRB view of who is an employee and issues surrounding alternative staffing:  joint employer, especially with temporary staffing; narrowing of independent contractor definition and broaden of employee 
    • Understand the issues with confidentiality agreements and non-competes.
